The Last Lie For January? Modi (Falsely) Claims Rape Accused Being Hanged Expeditiously

Conviction rate in rape cases is a mere 25% as per NCRB's 2016 data, and no rape convict has been executed since 2004.

Addressing a gathering in Surat on Wednesday, January 30, Prime Minister Narendra Modi lied about how rape cases are dealt with in India under his government.

ANI reported that the prime minister said, “Now, culprits are hanged within 3 days, 7 days, 11 days and a month.” It is a prima facie false claim since only four people have been hanged in the past 15 years in India. Only one of them, Dhananjoy Chatterjee, was hanged for rape and murder, and that too, in August 2004.

Even then, it is grossly inappropriate for the prime minister to attempt to brag about the number of people being executed in the country. In any civilised society, implementation of retributive justice in the form of death penalty is a matter of shame. Also, a number of studies have reported that fear of death penalty is not a deterrent to committing rape and in fact, poses a threat to the life of the victim even further.

Moreover, the prime minister seems to have forgotten the conduct of his own party’s lawmakers in the recent cases of rapes of minors in Kathua and Unnao that shocked the nation. While Bharatiya Janata Party (BJP) ministers in Jammu and Kashmir at the time took out a rally in support of the rapists and murderers of an 8-year-old girl in Kathua, BJP MLA Kuldeep Singh Sengar had walked into Uttar Pradesh Chief Minister Yogi Adityanath’s office with a wide grin on his face after being accused of rape by a 16-year-old girl in Unnao.

The Unnao survivor’s family received attention only after they attempted to kill themselves outside CM Adityanath’s residence. The survivor’s father was allegedly killed in police custody and the police was refusing to file an FIR in the rape case. It was only after the national outrage that the Central Bureau of Investigation was handed over the case. Even though a CBI chargesheet has been filed against Sengar, the survivor is being allegedly harassed by Sengar’s associates and the police. A cases of ‘forgery’ has been filed against her and the family.

The Unnao Survivor and the family of the Kathua victim are yet to receive justice.

MJ Akbar, BJP MP and former Minister of State External Affairs in the prime minister’s cabinet, was accused of sexual harassment by over 20 women journalists during India’s #MeToo movement. It took weeks of outrage before Akbar finally tendered his resignation and even then, the prime minister and all other party leaders remained tight-lipped about the issue. Akbar continues to be an MP and a BJP member even after being accused of sexual assault by US-based editor Pallavi Gogoi.

The Modi government has not released the National Crime Records Bureau’s 2017 report, but even the 2016 report shows that the conviction rate in rape cases is a mere 25.5 per cent. What is the prime minister bragging about?
