SC Reinstates Alok Verma as CBI Director, Says Modi Govt Did Not Have Authority to Send Him on Leave

The SC also sets aside appointment of M Nageswara Rao as interim chief of CBI.

The Supreme Court on Tuesday, January 8 announced its verdict on the plea filed by Central Bureau of Investigation (CBI) Director challenging the PMO order that divested him of his duties and sent him on leave. The court has said that the government did not have the authority to send him on leave.

“If there was intent to specify interim measures for Director CBI then the legislation would have contained the provision,” the court reportedly said, noting that the procedure of removing a CBI chief was set out in law.

The SC also sets aside appointment of M Nageswara Rao as interim chief of CBI.

Just a few hours after the CBI had closed in to clinch evidence on the role of its Special Director, Rakesh Asthana’s role in the bribery and money laundering case and stripped him of the charge for all the cases he was handling, the Modi government in a panic, had issued an order on the midnight of October 23, 2018.
